APPLICATION FOR REGISTRATION OF TOURIST ACCOMMODATION PREMISES GUIDELINES
WHO CAN APPLY?
- Accommodation premises such as hotels, lodging houses, boarding houses, rest houses and inns (with 10 rooms and above) or hostels (with 50 beds and above) that offer lodging or sleeping accommodation.
NAME OF PREMISES
- The name used by the premises shall be appropriate and reflect the accommodation premises.
REGISTRATION CERTIFICATE
- Shall be issued by the Commissioner of Tourism after he is satisfied with the suitability of the applicant.
MATTERS THAT DETERMINE SUITABILITY OF APPLICANT
- The Commissioner of Tourism may, in determining the suitability of an applicant, take into consideration:
- The types of accommodation premises
- The facilities and services offered or provided
- The number and experience of the employees should be appropriate with the size and services offered
- Membership of a Hotel Association recognised by the Ministry of Tourism, Malaysia
- Aspects of building safety
PROCESSING FEE
- A processing fee of RM20.00 shall be submitted with the application.
DOCUMENTS REQUIRED WHEN SUBMITTING APPLICATION
- Application Form 1 (Regulation 2(i) )
- If the applicant is a company, please attach:
- Copy of the company’s Memorandum and Articles of Association
- Copy of Form 24 - Return of Allotment of Shares
- Copy of Form 49 - Return Giving Particulars in Register of Directors, Managers and Change of Particulars
- If the applicant is a sole proprietor, please submit Copy of Business Registration
- Copy of the Hotel Association Membership Certificate (if applicable)
- Copy of the Certification of Fitness for Occupation/Copy of Tourist Accommodation Premises Business Licence by the local authority (Boarding House Licence)
- Copy of the Hotel Classification Certificate (if applicable)
REGISTRATION FEE
- A registration fee of RM50.00 is imposed and shall be submitted after the registration is approved.
METHODS OF PAYMENT
- All payments shall be made in the form of bank draft/money order/cashier’s order in the name of the Commissioner of Tourism, Ministry of Tourism. The name of the company and the Ministry’s file reference number (if any) shall be clearly written on the back of the bank draft/money order/cashier’s order.
SUBMISSION OF APPLICATION FORMS
- Licensing Division, Ministry of Tourism, Malaysia, Kuala Lumpur - Applications from the Federal Territory of Kuala Lumpur, Putrajaya, Selangor, Negeri Sembilan, sections of the districts of Pahang (Temerloh, Jerantut, Bera, Raub, Bentong, Kuala Lipis and Cameron Highlands) and sections of Perak (Ipoh, the districts of Tanjung Malim, Tapah, Teluk Intan, Lumut, Pangkor Island, Sitiawan and Batu Gajah)
- Northern Region Licensing Office - Applications from Kedah, Langkawi, Penang, Perlis and northern Perak which covers towns in northern Ipoh (the districts of Taiping, Grik, Lenggong, Sg Siput, Kampar, Kuala Kangsar and Krian)
- Eastern Region Licensing Office - Applications from Kelantan, Terengganu and sections of Pahang (Kuantan, Pekan and Maran)
- Southern Region Licensing Office - Applications from Johor, Malacca and parts of Pahang (Rompin and Pulau Tioman)
- Sabah Regional Licensing Office - Applications from Sabah and the Federal Territory of Labuan
- Sarawak Regional Licensing Office - Applications from Sarawak
ADOPTION OF HOTEL NAMES FOR TOURIST ACCOMMODATION PREMISES GUIDELINES
- The name of accommodation premises shall not be allowed to be re-used by another or other accommodation premises.
- The name should reflect tourism activities and should be appropriate to the type of premises (for instance: Hotel, Resort, Beach, Beach Resort, Inn, Hostel, Motel, Chalet, Bed & Breakfast, Lodge, Guest House, Rest House, Plaza, Residence, Park, Village, Ville, Spa, Apartel, Condotel).
- Tourism accommodation premises are not permitted to take the franchise name or the name of a hotel network of other tourist accommodation premises without the written permission or specific agreement of the trade patent-holder of the original tourist accommodation premises (E.g. Hotel Seri Malaysia, Shangri-La, Hyatt, Mandarin, Swiss Garden, Regent, JW Marriot, Federal, Berjaya, Hilton, Mutiara, Grand Continental, Renaissance, Holiday Villa, Sheraton, Concorde, Park Royal, Ritz-Carlton, and Pan Pacific)
- Tourist accommodation premises are not allowed to use names that have negative connotations in Bahasa Malaysia or any other local language or that reflect activities that are not healthy or in conflict with the values or culture of a race or religion in Malaysia.
- The names used by the tourist accommodation premises shall be appropriate with the facilities and services offered, for instance:-
- the use of the descriptive term ‘beach resort’ for tourist accommodation premises located in town is inappropriate because of the absence of a real beach
- the use of the word ‘resort’ shall be in reference to the facilities and activities offered, for instance golf and jungle trekking.
- The names of individuals or famous personalities can only be taken with the written permission of the respective individual(s) or heir(s) of the personalities concerned.
